A legal separation is different from a divorce in that the parties are still legally married. Our attorneys can explain these differences and ascertain if a legal separation is right for you.
Legal Separation
People may request a legal separation for a variety of reasons. Oftentimes, the parties are not emotionally ready or willing to obtain a divorce. The possibility of reconciliation may be prevalent, yet they may also seek to be protected from financial harm.
Sometimes, older persons may not want a divorce due to the loss of health insurance benefits. Thus a legal separation may be the answer.
Another reason a legal separation may be right for you, has to do with residency requirements. If you are new to California and have not lived here for at least six months, a legal separation will allow you to start the process.
A legal separation generally can be later amended into a divorce proceeding if desired.
There are a variety of reasons to obtain an annulment. Essentially, an annulment is an order from the court whereupon it is held that the marriage was not legally valid. There are a variety of statutory reasons the court may make such a ruling. Our attorneys can evaluate your situation to see if you may qualify for an annulment.
