Our society openly recognizes the need for Domestic Abuse Prevention laws in dealing with a problem which was once hidden behind closed doors. These laws are designed to provide protection to those person who have suffered abuse.
EPO
Referred to as an Emergency Protective Order, these orders are generally issued on scene by a law enforcement officer, after explaining the circumstances on the telephone to a judge and obtaining permission to issue the order. These orders are generally only good for 5 court days.
TRO
A Temporary Restraining Order is issued by the Court, oftentimes, the court may issue such orders upon an emergency hearing or upon reading the declaration of the alleged victim. These orders are generally only good for 21 days and may be reissued.
Upon the issuance of a TRO, the court will conduct a hearing to determine the need for a permanent restraining order. If granted, such orders will generally last up to five years; however, can be renewed for a lifetime.
Violation of a Domestic Violence Order
Violation of restraining orders is punishable by a civil penalty (money damages) and criminal penalties (jail time). These orders are taken very seriously by the courts in California.

If you have been accused of domestic violence, our lawyers can help you with your case. Domestic Violence Orders will have a direct effect upon your ability to own, buy or possess firearms. Further, your visitation with your children may occur at a supervised facility or not at all.
